OPEN MARKET — LISTING POLICIES

These Listing Policies (“Policies”) govern what content may be posted on Open Market and how listings are reviewed, displayed, and moderated. These Policies form part of the Open Market Terms of Service.

By creating or publishing a listing, you agree to comply with these Policies.

Violations may result in listing removal, reduced visibility, account restrictions, or termination, at Open Market’s discretion.


1. What Can Be Listed on Open Market

Open Market allows listings only within supported marketplace categories, including but not limited to:

  • Property for Sale (Residential, Commercial, Land)

  • Property for Lease (Residential, Commercial)

  • Rooms for Rent

  • Local Services

  • Buy & Sell

  • Food & Beverage

  • Groceries

Listings outside supported categories, or that do not follow category rules, may be removed or restricted without notice.


2. Listing Accuracy and Authority

By posting a listing, you represent and warrant that:

  • you have the legal right and authority to post the listing

  • information provided is accurate to the best of your knowledge

  • pricing, availability, and descriptions are not intentionally misleading

  • you have permission to use all photos, text, and media included

Open Market does not verify listings, ownership, licensing, authority, or legality.
All responsibility rests entirely with the user who posts the listing.


3. User Due Diligence and Risk

Open Market is a publishing platform and not a broker, agent, property manager, service provider, or transaction intermediary.

Users are solely responsible for their own due diligence, including but not limited to:

  • verifying ownership, title, zoning, permits, or authority

  • confirming pricing, terms, and availability

  • performing inspections or reviewing disclosures

  • verifying licenses, insurance, or qualifications of service providers

  • complying with all applicable local, state, and federal laws

All interactions and transactions occur at the user’s own risk.


4. Prohibited Listings and Content

You may not use Open Market to post, promote, or facilitate:

  • illegal goods, services, or activities

  • fraud, scams, impersonation, or deceptive practices

  • fake, bait, or misleading listings

  • discriminatory, hateful, abusive, or harassing content

  • sexually explicit services or content

  • unsafe meetups or instructions encouraging unsafe conduct

  • listings that violate zoning, housing, consumer protection, or other laws

  • content you do not have the right to use or distribute

Listings that violate these rules may be removed or restricted immediately.


5. Pricing, Availability, and Representation

Listings must clearly and honestly represent:

  • pricing and fees (where applicable)

  • availability status

  • material conditions or limitations

Misleading pricing, false availability, or bait-and-switch behavior is prohibited.

Open Market may remove, limit visibility, or restrict listings that create confusion, risk, or misuse of the platform.


6. Listing Credits, Plans, and Visibility

Some listings require an active subscription or available listing credits.

  • listing limits and eligibility depend on the selected plan

  • listing credits may apply across eligible categories based on plan rules

  • unused credits may expire or be forfeited

  • paid plans and visibility enhancements do not guarantee inquiries, leads, sales, or rentals

Subscription fees are for platform access and publishing tools—not outcomes.


7. Moderation and Enforcement

Open Market reserves the right, at its sole discretion, to:

  • remove, edit, or restrict any listing

  • reduce visibility or search placement

  • suspend or terminate accounts

  • take enforcement action without prior notice

Open Market is not obligated to provide explanations, warnings, or reinstatement.

Repeated or severe violations may result in permanent account removal.


8. No Endorsement or Guarantees

Open Market does not endorse, verify, or guarantee any listing, user, property, service, or outcome.

Publishing a listing does not imply approval, verification, or recommendation.


9. Relationship to Terms of Service

These Listing Policies are incorporated into and governed by the Open Market Terms of Service.

Violations of these Policies may result in enforcement under the Terms, including suspension or termination of access to the Services.


10. Changes to Listing Policies

We may update these Listing Policies at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Policies.
